PHOTOGRAPHY CONTRACT

Terms and conditions

Session fee is $175 and pay is only for the photographer's time and artistic vision during the session.

Your session fee includes an initial consultation via phone, email or in person, and approximately one hour of coverage on day of session. It also includes images in an online password-protected gallery for viewing and ordering purposes once all post-processing is completed. 

Prints/proofs DO NOT come with the session. 

Print prices are separate from the session fee.

There is a $500 minimum order requirement with the commitment of the "original experience" session. 

The "Digital Experience" is excluded from the minimum purchase requirement. 

Mini session prices vary, and are not subject to the $500 minimum. 

In order to hold your appointment, your session fee must be received at least SEVEN DAYS prior to your session date. The session fee is nonrefundable, but we will reschedule once, if you encounter a problem. Please be sure to notify us at least 48 hours prior to the session if you should need to reschedule. If weather becomes an issue, we will certainly reschedule for another day.   

Your images will be available approximately three weeks following your session and will be presented to you in an online, password-protected gallery. At that time, you are able to make your portrait purchases. There are typically 30 images to choose from. The gallery will be available for two weeks. A re-hosting fee of $25 will be applied for each additional day required. 

You are encouraged to share your gallery with family and/or friends for viewing. Orders may be placed either online, through the proofing gallery, or directly through me. 

The payment for any order is due IN FULL when you place your order. All orders placed during the previewing. Should be available in 2 to 4 weeks from the date the payment is received (and checks cleared). 

Images from your order will be kept on file for one year for additional reprints at a later date. A minimum order of $100 is required for future purchases.

ALL ORDERS ARE FINAL. There will be no returns on prints or products. NO EXCEPTIONS. 

COPYRIGHT POLICY

The federal Copyright Law protects copyright. It is unlawful to copy or scan any image without permission from the photographer. Even though the pictures may be of you or your child, the photographer still owns the copyright to the images.

In order to control the quality of the work produced, the photographer is the only one who has permission to crop, order or modify any image from the photo session.

The photographer retains the copyright and ownership of all images from the session and reserves the right to reproduce images for portfolio, studio display, website, gallery display, self-promotion, contests, commercial work, etc.

CLIENTS ARE NOT ALLOWED TO REPRODUCE ANY IMAGES PRODUCED BY THE PHOTOGRAPHER FOR ANY PURPOSE. Likewise, clients cannot authorize any reproduction of images for commercial use, personal use, photographic competition or display, without express consent from the photographer.

This includes scanning of work on store picture makes, or other printing or scanning devices or services at stores, or on home printers or scanners, as well as onlone labs. Violators will be prosecuted.

NO EQUIPMENT OTHER THAN PHOTOGRAPHERS IS ALLOWED AT THE SESSION. 

As of today, the standard prices for a la carte prints are:

$30 - gift prints (8x10 and smaller)

$30 - 8 wallets

$100 - 11x14 mounted 

$125 - 16x20 mounted 

$200 - 20x24 mounted

Canvases, custom albums, cards, and more are also available. 

All items are priced from the standard price list in effect at the time of this agreement. Prices are guaranteed for 30 days from date of session. Any orders place beyond the 30 days will be charged according to the most recent price list. 

MODEL RELEASE

I grant full ownership and copyright of all photographs produced within the session to Kelly Rhoades Photography along with the right to reproduce any of the images (and by any means chosen). 

I am also in agreement that any licensee or assignee in legal correspondence with Kelly Rhoades Photography can use the photographs in anyway and in any medium. 

The photographer, licensees, and/or assignees, hereby obtain the rights to use the photographs under no restrictions whatsoever and for whatever purposes, including advertising with any post processing or manipulation within reason.

I agree that any of the above mentioned photographs or manipulations used by the photographer licensees and/or assignees to represent an imaginary person so I'm not reflect upon me personally and less I give legal permission to use my full name.    

I commit to withdraw from making any legal claims or disputes against either of the photographer and her agents in regards to image usage and understand fully that the photographer is under no legal obligation to compensate me for the use of any photos.
